Imagine a world where students feel confident that their personal information, grades, behavioural records, health details, and even learning preferences are safe. Educational institutions hold a lot of sensitive personal data: names, birthdates, grades, health or special education records, financial data, and more. When this data is breached, consequences are immediate and often severe. In Q2 of 2025, for example, educational organisations faced, on average, 4,388 cyberattacks per organisation per week, a 31% increase year-over-year. Schools and vendors should use child-friendly language or ensure notices are accessible to both students and parents. Under the GDPR, for example, institutions must provide data subjects with privacy notices that are clear, intelligible and easily accessible.

Consent must be genuinely informed: individuals (or their legal guardians in the case of minors) should be aware of what they are agreeing to. They should have the option to refuse or withdraw consent without unreasonable penalty.

No system is perfect. When breaches happen, how an institution responds matters tremendously. Prompt notification to affected individuals, transparent explanation of what occurred, what data was impacted, and what steps are being taken are essential.

AI tools that anonymise sensitive information 

Where large‐scale analytics or AI are used, anonymisation techniques can ensure individual students are not identifiable. Techniques such as data masking, aggregation, and differential privacy can help. 

AI can also assist in monitoring compliance: detecting unusual data access, flagging potential leaks, and helping with anonymising data before sharing or using it for research. 

Platforms with compliance certifications like GDPR 

Regulatory frameworks matter. Institutions using platforms certified under GDPR, ISO/IEC 27001, or other recognised privacy/security standards get external validation of their processes. Certifications assure stakeholders, students, parents, and regulators that data protections are not just talked about but audited, enforced, and verified.

Understanding the legal and regulatory environment is essential for ethical data use. 

  • General Data Protection Regulation (GDPR): In Europe and for any institution handling data of EU citizens, GDPR mandates principles like lawfulness, fairness, transparency, purpose limitation, data minimisation, accuracy, storage limitation, integrity and confidentiality, accountability. 
  • FERPA (USA): FERPA governs access to and sharing of student education records. Institutions must protect personally identifiable information in student records. Parents and eligible students have the right to inspect, correct, and control disclosure. 
  • National and State Laws: Many countries have their own laws (e.g. Nigeria has the Nigeria Data Protection Act; others have data protection laws that apply to digital service providers, schools, etc.). Also, within federated countries or states, local laws may add stricter requirements. 
  • Regulations around vendor contracts and third-party data processors: EdTech providers, school administrators, and third-party vendors must define roles (data controller, data processor, etc.), ensure contracts include privacy clauses, and ensure vendor compliance.
